About these terms
This website at gridpass.com.au is operated by Grid Pass Pty Ltd, ABN 72 700 045 807 ("Grid Pass", "we", "us"). By using this site you agree to these terms. If you do not agree to them, please do not use the site.
These terms are written to be read. If anything in them is unclear, ask us at support@gridpass.com.au and we will explain it.
What this website is, and what it isn't
This site describes the Grid Pass service: an engineering service that prepares, lodges and tracks grid connection applications for solar retailers and installers.
It is a description, and only that. In particular:
- Nothing on this site is engineering advice for a particular project. Connection requirements turn on the site, the network, the equipment and the standards in force at the time. Get advice for your job.
- Nothing on this site is an offer capable of acceptance, and using the site does not make you a Grid Pass customer or create any obligation on us to take on your work.
- We do not guarantee that any application will be approved. Approval is the network's decision, on its own criteria and its own timeframes.
The Grid Pass platform is a separate agreement
These terms do not cover the Grid Pass platform at app.gridpass.com.au. Signing up there is a separate agreement, covering fees, what we will and won't do, how your data is handled, service levels, and how either of us can end it. You agree to that agreement when you create an account.
If the two documents ever conflict about the platform, the platform agreement wins. These terms govern the website.
Using this website
You may read this site, and share links to it, for any lawful purpose. You must not:
- use it in a way that breaks the law, or that infringes anyone's rights;
- try to interfere with the site or the systems it runs on — attacking it, probing it for vulnerabilities, or attempting to get access you have not been given;
- scrape or harvest the site systematically, or use it to build a competing product or dataset;
- copy substantial parts of the site's content and present them as your own;
- misrepresent your association with Grid Pass.
Reasonable, ordinary use of a public website is fine. This clause is aimed at abuse, not at readers.
Accuracy of what you read here
We take care to keep this site accurate and current, and we correct mistakes when we find them. But grid connection is a moving target: network requirements, standards, forms and thresholds change, sometimes at short notice, and the sixteen distribution networks do not change them in step.
Before you rely on anything here for a real project, check the network's own current published requirements. They are the authority on their own connection process. We are not.
Where this site refers to the number of networks we cover, or to a network's process, that reflects our position at the date at the top of this page.
Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, services must be supplied with due care and skill, be fit for any purpose we have been told about, and be supplied within a reasonable time.
Nothing in these terms excludes, restricts or modifies those guarantees, or any other right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where any part of these terms would do so, that part does not apply.
Section 7 is read subject to this section.
Our liability
Subject to section 6, and to the extent the law allows:
- our liability for a failure to comply with a consumer guarantee, where the services are not of a kind ordinarily acquired for personal, domestic or household use, is limited to supplying the services again or paying the cost of having them supplied again — whichever we choose, provided that choice is fair and reasonable in the circumstances;
- we are not liable for indirect or consequential loss, or for loss of profit, revenue or business opportunity, arising from your use of this website;
- our liability is reduced to the extent that your own act or omission, or that of someone you are responsible for, caused or contributed to the loss.
This section is about the website. Liability under the platform agreement is dealt with in that agreement.
Intellectual property
The content of this site — its text, design, illustrations, photography, icons, animations and code — belongs to Grid Pass or to the people who licensed it to us, and is protected by copyright.
You may read it, print it and link to it. You may not republish it, sell it, or use it commercially without our written permission. The Grid Pass name and logo are our trade marks, and you may not use them without our permission except to refer accurately to us.
Network names and logos
This site shows the names and logos of Australian electricity distribution networks. Those marks belong to the networks, not to us. We use them for one purpose: to identify the networks we can lodge applications with.
Showing a network's logo does not mean that network endorses, sponsors or is affiliated with Grid Pass. If you are a network and would rather we did not display your mark, email support@gridpass.com.au and we will remove it.
Links to other websites
This site links to other websites, including the networks' own sites and the Grid Pass platform. We do not control the sites we link to and are not responsible for their content, their accuracy or their privacy practices. A link is not an endorsement.
Privacy
How we handle personal information is set out in our privacy policy, which forms part of these terms.
Worth repeating from that policy: if you send us details about your customers, you need to have told them and be entitled to share them.
Availability of the site
We aim to keep this site available, but it is a website — we do not promise it will always be up, and we may change, suspend or withdraw any part of it. Where we can reasonably give notice of a change that affects you, we will.
Changes to these terms
We update these terms from time to time. The current version is always at gridpass.com.au/terms, and the date at the top tells you when it last changed. Changes apply from the day they are published, and using the site after that means you accept them.
We will not apply a change retrospectively to something that has already happened.
Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of its courts, which leaves you free to bring a claim elsewhere if the law entitles you to.
If any part of these terms turns out to be unenforceable, the rest of them still apply.
